Introduction

SIKUL is a digital platform created by the Association Camerounaise pour le Marketing Social (ACMS) which makes online learning services available to health professionals. The content and information made available on this platform (including, without limitation, data, information, text, photographs, maps, icons, software, codes or any other material), as well as the infrastructure used to provide this content and information is the exclusive property of SIKUL. For the purposes of these Terms and Conditions, reference to the Platform also means reference to “SIKUL”.

Who are we?

The Association Camerounaise pour la Marketing Social (ACMS) is a Cameroonian non-profit organization whose objective is to improve the living conditions of vulnerable populations. It is very important to ACMS to provide you with reliable and personalized information about your health when you use our services. Below are SIKUL’s terms of use:

1. Sikul terms of use

   You agree not to modify or otherwise copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, sell or resell any information, software, products or services obtained from from or through this Platform. Additionally, you agree not to:

   • use this platform or its content for any commercial purpose.

   • Access, monitor or copy any content or information from this Platform using any robot, spider, scrape or other automated means or manual process for any purpose, without the express written permission of ACMS, which permission may be refused with or without justification.

   • Violate any restrictions contained in any robot exclusivity header on this Platform or circumvent other measures applied to prevent or limit access to this Platform

   • Frame, copy, duplicate, mirror or incorporate in any manner any part of this Platform into any other website/application without our prior written permission, which may be withheld, with or without justification

   • Attempt to modify, translate, adapt, edit, decompile, disassemble or reverse engineer any software programs used by us in connection with the Platform or its Services.

   • Manipulate any feature or service thereof

   • Violate industrial and intellectual property rights or regulatory standards regarding the protection of personal data.

   • Use SIKUL to insult, defame, intimidate, violate your own image or harass other users or any other third party.

   • Enter the email accounts, profiles and/or other personal data of other users

   • Introduce computer viruses, defective files or any other computer programs that may damage or modify the content of SIKUL’s or third parties' systems.

   • Send emails of a massive and/or repetitive nature to several people, send the email addresses of third parties without their consent.

   • Carry out advertising activities for goods or services without the prior consent of SIKUL, which consent may be refused with or without justification.

   Any user may report another user if he or she considers that the latter is not complying with these general conditions of use. Furthermore, any user can inform SIKUL of any abuse or vulnerability of these conditions, through the contact form. SIKUL will verify this report as soon as possible and take such action as it deems appropriate, reserving the right to remove and/or suspend any user from SIKUL for noncompliance with these Terms of Use. SIKUL also reserves the right to remove and/or suspend any post(s) containing illegal or offensive content, without notice or additional notification.

2. Customer access and registration

   To be a SIKUL user it is essential that the following conditions are met:

   • Be of legal age.

   • Completely fill in the mandatory fields of the registration form, in which personal data such as username, e-mail and telephone number are requested.

   • Accept & consent to these Terms.

   • Accept the privacy and data protection policy.

   • Accept the cookie policy.

   The user guarantees that all data about their identity is true, correct, and complete; pledging to keep it up to date.

   If a user provides false, incorrect or incomplete data or if SIKUL believes that there is good reason to doubt its truthfulness, accuracy and integrity, SIKUL may refuse access for current or future use. of SIKUL or any of its contents and/or services.

   The user undertakes not to disclose data relating to their account or make them accessible to third parties. The user will be solely responsible in case of access and/or use of this data by third parties, including all acts carried out at Sikul or any other expression of will when using the username and/or password.

   Sikul cannot guarantee the identity of registered users, therefore, it will not be responsible for the misuse of a certain profile of a registered user, by non-registered third parties. Users undertake to immediately inform Sikul of the removal, disclosure or loss of their username or password, through the contact form.

3. Review/rating

   We value your opinion. Please note that by submitting Content to this Platform by email, posting on the Platform or otherwise, including any notation of questions, comments, suggestions, ideas or similar forms contained in any Submission (collectively, " Submissions"), the user grants SIKUL and its affiliates a nonexclusive, royalty-free, perpetual, transferable, irrevocable and fully sublicensable right to such Submissions. For the purposes of these Terms and Conditions, Content and Submissions include, without limitation, messages, data, information, text, music, sounds, photographs, graphics, code or other material.

   Sikul contains evaluation services or other forums on which the user can leave comments about their experiences. The user will be solely responsible for his/her comments and ratings, for which he/she expressly agrees not to use this platform to post, transmit or publish:

   • content that is illegal, libellous, defamatory, obscene, pornographic, indecent, lewd, suggestive, provocative, threatening, infringing privacy or publicity rights, abusive, inciting, fraudulent or otherwise objectionable.

   • content that may constitute, encourage or provide instructions for an offence, violation of any party's rights or that otherwise creates civil liability or violates any local, state, national or international law.

   • content that may infringe on any patent, trademark, trade secret, copyright or other intellectual property rights or proprietary rights of any party.

   • content that impersonates any person or entity or misrepresents your affiliation with a person or entity, including Sikul.

   • unsolicited promotions, political campaigns, advertisements, contests, sweepstakes or solicitations.

   • Private information of third parties, including, but not limited to, last name, addresses, telephone numbers, email addresses, social security number, and credit card numbers.

   Sikul assumes no responsibility for any content posted, stored, or uploaded by the user, or for loss or damage, and is also not responsible for any error, defamation, slander, omission, falsehood, obscenity, pornography, or rudeness that the user may identify.

   As an interactive service provider, Sikul is not responsible for any statements, representations or content provided by users in any public forum, personal page, or other interactive areas.

   Although Sikul has no obligation to select, edit or monitor any content posted or distributed through its platform, Sikul reserves the right, in its absolute discretion, to remove, analyse, translate, or edit, without prior notice, any content posted or stored on this platform at any time and for any reason, or performing such actions through third parties on your behalf. The user is solely responsible for the creation of backup copies and the replacement of any content that they publish or store on this platform at their sole expense.

4. User obligations

   Users are entirely responsible for the access and correct use of their profile and the contents of SIKUL in relation to these conditions of use, the legislation in force, whether national or international, provided that it is applicable in the country from which the user accesses SIKUL, as well as the principles of good faith, morality, good customs and public order.

   The user will refrain from using their profile and SIKUL content for purposes that are illicit or prejudicial to the rights and interests of third parties, or likely to damage, disable, affect or deteriorate in any way. or SIKUL, its contents and its services. It is also prohibited to prevent the normal use of SIKUL by other users.

5. Disclaimer & limitation liability

   PLEASE READ THIS SECTION CAREFULLY. THIS SECTION LIMITS SIKUL’S LIABILITY TO YOU FOR PROBLEMS THAT MAY ARISE AS A RESULT OF YOUR USE OF THIS PLATFORM. IF YOU DO NOT UNDERSTAND THE TERMS CONTAINED IN THIS SECTION OR ANY OTHER FEATURE OF THE PLATFORM, PLEASE CONSULT AN ATTORNEY FOR CLARIFICATION BEFORE ACCESSING OR USING THIS PLATFORM.

   • We do not guarantee the operation of SIKUL or the information, content, tools or materials on the platform. You agree to use SIKUL at your own risk.

   • We do not warrant that the information, content, tools or materials included in SIKUL, electronic communications we send are free of viruses or other harmful components. We will not be liable for any damages of any kind arising from your use of the Digital Companion or from any information, content, tools or materials included in or made available to you through the Digital Companion, including direct damages, accidental, punitive and/or consequential.

   • We are fully committed to providing you with the best possible service. However, we are not responsible for:

     • Any interrupted, delayed or failed transmission, storage or delivery of information due to power outage, equipment or software malfunction, natural disasters, fire, industrial unrest or any other reason. cause beyond our reasonable control;

     • Any inaccurate, incomplete or inadequate information obtained from the digital companion;

     • We will also not be liable for any direct or indirect loss or damage which may result from the following:

       • Any of the events described in this paragraph or in the preceding paragraphs.
       • Any action or omission on your part resulting in a breach of these terms and conditions.
       • Any refusal of access to the Website if we believe or have reason to believe that you are carrying out activities that are illegal, abusive, likely to undermine the integrity of SIKUL or bring ACMS into disrepute;
       • Your trust in the information, content, tools or materials you obtain through the Digital Companion.

     • To the extent that clinical information may be provided on the Digital Companion, it is based on best practice and current recommendations and guidelines. These obviously change from time to time. The information provided should not replace the advice of a licensed health care provider. You should not discontinue any treatment you may receive based on the information contained in this digital companion without first consulting your health care provider. You should also consult a healthcare professional immediately when you are ill.

   SIKUL assumes no responsibility for content posted, stored or uploaded by the user, nor for loss or damage, nor is it liable for any errors, defamation, slander, omissions, falsehoods, obscenities, pornography or rudeness that the user might identify.

6. Updating and modifying the platform

   SIKUL reserves the right to modify, at any time and without notice, these conditions of use, the privacy policy and the cookies policy. Use of these Terms of Use, Privacy Policy and Cookie Policy after they have been modified will be deemed acceptance of the modified terms. Users should read these Terms of Use carefully when entering the SIKUL Site. In any case, acceptance of the conditions of use will be a preliminary and essential step to access the services and content available through SIKUL.

   SIKUL reserves the right to carry out, at any time and without notice, updates, modifications or deletions of the information contained on SIKUL, in the configuration and presentation thereof and in the conditions of use. access, without assuming any responsibility in this regard. SIKUL does not guarantee the nonexistence of interruptions or errors in access to SIKUL or its content, nor that it is always up to date. However, SIKUL undertakes to carry out and implement, provided that there are no causes that make the realization impossible or difficult, and as soon as there is news of errors, disconnections or lack of content updates, all work aimed at correcting errors, restoring communication and updating content

7. Intellectual property

   SIKUL is the owner or licensee of all intellectual and industrial property rights included in SIKUL as well as in the content accessible through it. The intellectual property rights of SIKUL, as well as: the texts, images, graphic design, navigation structure, information and content collected therein are the property of SIKUL or are subject to a license from its part, to whom it is up to exercise the rights of exploitation in any form whatsoever and, in particular, the rights of reproduction, distribution, public communication and transformation, In accordance with the legislation of the African Organization of Intellectual Property (OAPI), in particular the Bangui Agreement, Act of November 14, 2015.

   The authorization for the user to access SIKUL does not imply the waiver, transfer, license or total or partial assignment of the intellectual or industrial property rights of SIKUL. It is prohibited to delete, circumvent or manipulate in any way the contents of SIKUL. Furthermore, it is strictly prohibited to modify, copy, reuse, explore, reproduce, publicly communicate, make secondary or subsequent publications, upload files, email, transmit, use, process or distribute in any way all or part of the contents included in SIKUL for public or commercial purposes, without the express written authorization of SIKUL or the rights holder

   The user who disseminates any type of content through SIKUL guarantees that he has the necessary rights to do so, SIKUL being exonerated from any responsibility for the content and legality of the information presented. The provision of content by users through SIKUL implies the transfer to SIKUL, free of charge and to the extent permitted by current legislation, of the exploitation rights of the intellectual or industrial property derived from this content.

8. Jurisdiction and applicable law

   This platform is operated by a company constituted and regulated in accordance with the laws in force in the Republic of Cameroon and these conditions of use are governed by the Bangui Agreement establishing the African Intellectual Property Organization (OAPI), revised on November 14, 2015 and the laws in force in the Republic of Cameroon. The user therefore accepts the non-exclusive jurisdiction of the organs of OAPI and the Cameroonian courts and guarantees the fairness and convenience of the procedures before these bodies and courts for all disputes arising from the use of this platform or related to this one. The user accepts that all claims he may have against SIKUL, arising from or linked to this platform, will be heard and resolved as the case may be, by the organs of OAPI or by the Cameroonian courts. Use of this platform is not authorized in states where these terms of use are not applicable.

Privacy policies

SIKUL wants the user to feel confident when using the platform and is committed to protecting the information it collects. Although no site can guarantee absolute security, we have put in place appropriate administrative, technical and physical procedures to protect the personal information you provide to us. For example, only authorized employees have access to personal information and may do so only to perform authorized functions. In addition, we use encryption when transmitting the user's personal information between the respective system and the system used by SIKUL, as well as that of partners with whom we share confidential information. Additionally, we use firewalls and intrusion detection systems to prevent unauthorized persons from accessing user information. SIKUL collects, processes and transmits users' personal data in accordance with the applicable provisions of the data protection law in force in Cameroon and the Central African Economic and Monetary Community (CEMAC), in particular (i) Law no. °2010/12 of December 21, 2010 relating to cybersecurity and cybercrime in Cameroon; (ii) Law No. 2010/013 of December 21, 2010 governing electronic communications in Cameroon (iii) Law No. 2010/021 of December 21, 2010 governing electronic commerce in Cameroon which specifically concerns electronic commerce and may also affect to the protection of personal data.

SIKUL receives and stores any information that the User enters on the Platform or provides in any other way. This includes information that identifies the user (personal information), such as first and last name, telephone number, email address and username. We also store data about user surveys and comments. The user has the option not to provide information, but, in general, certain information concerning him is necessary for him to receive relevant offers from SIKUL and its partners and for him to benefit from other advantages linked to their registered user status. For example, only registered members can access courses.

SIKUL may collect data about the user's location if the user has configured their device to send this data to the application through the device's privacy settings, or if the user has uploaded photos with tags containing location information. SIKUL may use location information collected from the user's device to improve the use of the application by providing you with relevant content and contextual advertisements. SIKUL may also collect information on the user's searches and, considering their location, suggest services/establishments and/or products that may be of interest to the user

SIKUL automatically collects certain information from the user's computer or device when the user uses the SIKUL platform. For example, SIKUL will collect session data, including the user's IP address, operating system, and the type of device used to access SIKUL. One of the reasons SIKUL collects this information is to try to understand the user's interests and preferences in order to personalize and improve their experience.
